As finally presented to the trial court, this action sought declaratory relief construing secs. 56.18 (2), 66.12 (1) (c), and 176.43 (1), Stats., relating to the amount of money the defendant Milwaukee county can charge the plaintiff city of Milwaukee for the confinement in the county jail and house of correction of prisoners convicted of violating Milwaukee city ordinances. In 1962 the city refused to make any payments after January 1st claiming it had been overcharged and had overpaid for prisoners for the years 1956 through 1961 the sum of $552,825.02, recovery of which is sought as incidental relief. In its counterclaim, Milwaukee county seeks payment for the year 1962 in the amount of $214,690.10.
