The appellant was charged with a violation of sec. 101-135 of the Milwaukee Code of Ordinances in that he parked his automobile
on a restricted street for more than two hours between 2 a. m. and 6 a. m. without obtaining a special permit, for which a
fee is charged, from the Milwaukee police department. The action was tried in the branch of the county court of Milwaukee county presided over by Judge John E. Krueger. Judge
Krueger dismissed the charge, stating that the city had failed to comply with sec. 349.13 (1), Stats., in that no signs were
erected "in the block or on the highway" where Mr. Hoffmann parked his automobile. In addition, the county court declared
the ordinance unconstitutional because "the city may not derive revenue in the manner set forth in this ordinance."
